Welcome to 46 Furniture Gallery Corp. By accessing or using our website, visiting our showroom,
or purchasing products from us, you agree to be bound by these Terms & Conditions.
Please read them carefully before placing an order.

1. General Information

These Terms & Conditions govern all purchases made through our website,
showroom, telephone, email, or any other sales channel.

46 Furniture Gallery Corp. reserves the right to modify these Terms & Conditions
at any time without prior notice. Any changes become effective immediately upon publication on this website.

2. Product Information

We strive to ensure that all product descriptions, specifications, dimensions,
pricing, and images are accurate. However, errors may occasionally occur.

We reserve the right to:

• Correct pricing or typographical errors.
• Modify product specifications without prior notice.
• Discontinue products at any time.
• Limit quantities available for purchase.

Product availability is not guaranteed until your order has been accepted.

3. Pricing

All prices are listed in U.S. Dollars.

Prices are subject to change without notice.
Applicable taxes, delivery charges, assembly fees, and other applicable charges will be added where required.

4. Payment

Orders are processed only after payment has been received or financing arrangements have been approved.
Financing approvals are subject to the policies of the financing provider.

5. Special Orders

Many of our products are ordered directly from the manufacturer specifically for each customer.
Once a special order has been submitted to the manufacturer,
it cannot be modified, canceled, exchanged, or refunded except where required by law.

6. Delivery Estimates

Estimated delivery dates are based on information supplied by manufacturers and shipping carriers.
While every effort is made to meet these dates, delays beyond our control may occur.

7. Delivery Requirements

Customers are responsible for ensuring purchased merchandise can safely fit through
doorways, hallways, stairways, elevators, and into the intended room.

Our delivery personnel are not responsible for removing doors or windows,
performing construction work, hoisting furniture unless previously arranged,
or moving existing furniture unless specifically included.

Additional labor or specialized delivery services may result in additional charges.

8. Delivery Appointments

Customers will be contacted once merchandise arrives at our Preparation & Distribution Center.
Delivery appointments should be scheduled promptly.

Missed appointments or cancellations with less than 48 hours notice may result
in additional delivery or redelivery charges.

9. Storage Policy

Merchandise should be accepted within seventy-two (72) hours of notification
or by the scheduled delivery date, whichever is later.

Storage fees of $25.00 per week, per item may apply after this period.
Merchandise not accepted within fourteen (14) days may be released from inventory
and a replacement order may require additional charges.

10. Inspection Upon Delivery

Customers are responsible for inspecting all merchandise upon delivery.

Visible damage, shortages, manufacturing defects, or incorrect merchandise must be reported
within 24 hours of delivery.
Failure to report issues within this period may affect warranty or service eligibility.

11. Assembly

Assembly or installation services are provided only when specifically included with the purchase.
The Store is not responsible for damage resulting from assembly performed by anyone other than our authorized personnel.

12. Warranty

Manufacturer warranties apply only to eligible merchandise.
Warranty coverage does not include damage resulting from:

• Normal wear and tear
• Improper assembly by others
• Customer misuse or abuse
• Accidental damage
• Pet damage
• Water or fire damage
• Improper cleaning methods
• Commercial use unless specifically approved

13. Layaway Purchases

Layaway purchases remain active for six (6) months.
Delivery generally requires approximately three (3) to four (4) weeks after the balance has been paid in full.
Layaway payments are non-refundable.

14. Returns, Exchanges & Cancellations

• Special order merchandise cannot be canceled or returned.
• Delivered merchandise may not be returned because of buyer’s remorse.
• Exchanges are approved solely at the Store’s discretion.
• Merchandise refused upon delivery, unless due to verified damage or Store error, is subject to a 30% restocking fee.

15. Color & Material Variations

Product photographs, showroom displays, catalogs, advertisements,
social media, and website images are intended as general representations only.

Actual products may vary slightly in color, fabric, leather grain,
wood grain, stitching, finish, dimensions, and decorative details due to
lighting, photography, monitor settings, natural materials,
and manufacturer production processes.

Such variations are normal and are not considered manufacturing defects.

16. Customer Measurements

Customers are responsible for measuring all access points before purchasing,
including:

• Doorways
• Hallways
• Stairways
• Elevators
• Ceiling heights
• Room dimensions
• Any other access points

The Store is not responsible if purchased merchandise cannot be delivered or placed
in the intended location because of insufficient space or access.
Additional delivery attempts, special handling, or return transportation
will be billed to the customer.

17. Limitation of Liability

To the fullest extent permitted by law,
46 Furniture Gallery Corp. shall not be liable for indirect,
incidental, consequential, or special damages arising from the purchase,
delivery, or use of any merchandise.

Our maximum liability shall not exceed the amount paid
for the specific merchandise giving rise to the claim.

18. Website Accuracy

Although we strive to keep our website accurate and current,
we do not guarantee that all information is complete,
accurate, or error-free at all times.
Prices, promotions, financing offers,
availability, and product specifications may change without notice.

19. Intellectual Property

All content on this website,
including text, graphics, photographs,
videos, logos, icons, and designs,
is the property of 46 Furniture Gallery Corp.
or its licensors and may not be copied,
reproduced, or distributed without prior written permission.

20. Privacy

Your use of this website is also governed by our Privacy Policy,
which explains how we collect, use, and protect your personal information.

21. Governing Law

These Terms & Conditions shall be governed by and interpreted in accordance
with the laws of the State of New Jersey.
Any legal action arising from these Terms shall be brought exclusively
in the state or federal courts located within the State of New Jersey.
